Lawsuit agains restaurant, tow truck and driver of broken down vehicle
This is unbelievable. Josh Hancock was a pitcher for the St. Louis Cardinals whose BAC was over twice the legal limit, was on a cell phone, speeding and not wearing a seatbelt when he struck the back of a flatbed tow truck that was at the scene of a broken down vehicle. Hancock was killed, and now his father is bringing a lawsuit against the restaurant where Josh was served, the tow truck driver (“for being there an extrodinary amount of time” – 15 min), and the driver of the vehicle that was stalled (“for being negligent in allowing his vehicle to reach the point where it stalled on the highway”).
I can empathize with the pain in his loss, but seriously … negligent in allowing his vehicle to reach the point where it stalled on the highway?
It surely had nothing to do with: “Authorities said the 29-year pitcher had a blood alcohol content of nearly twice the legal limit when he crashed into the back of the tow truck. He was also speeding and using a cell phone and wasn’t wearing a seat belt, police chief Joe Mokwa said after the accident. Marijuana was also found in the SUV.”
